# Morph — Terms of Use **Effective date:** 26 August 2026 **Terms version:** 2026-08-26-full-experience-v9 These Terms of Use ("Terms") are a contract between you and **WAQAS HAFEEZ ARAIN**, the app provider, seller, and developer identified on Morph's Apple App Store product page ("MORPH," "we," "us," or "our"). They govern the Morph application, accounts, websites, reports, subscriptions, and related services (together, the "Services"). Your iOS app license is subject to the Apple Standard EULA accepted through the App Store. Before the first face study, tapping **Agree & enable full experience** confirms your eligibility, electronically signs and accepts these Terms, and explicitly permits every processing purpose and recipient disclosed in Section 5; Morph's website checkout may also ask you to accept them. These are Morph's single Terms of Use. They include the face-data notice and destruction schedule, subscription terms, and health and cosmetic disclaimers that previously appeared as separate app documents. If you do not agree, do not use the Services. The separate Privacy Policy is a notice explaining our data practices and your choices; it is not another terms agreement. ## 1. Apple license terms The Apple Standard Licensed Application End User License Agreement ("Standard EULA") governs your license to the iOS application unless the App Store product page displays a custom EULA. These Terms govern the Services and supplement, but do not replace, that app license. The Standard EULA is available at: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ Apple is not a party to these Terms and does not operate or endorse Morph. Questions, support requests, and claims about Morph must be directed to us, not Apple. Apple and its subsidiaries retain the rights given to them under the Standard EULA and Apple Media Services terms. ## 2. Eligibility and authority You must be at least 18 years old to use Morph. Before face analysis, the app validates your date of birth during onboarding, repeats your adult confirmation in the disclosed **Agree & enable full experience** action, and obtains your electronic signature for these Terms, including Section 5's on-device face-data processing notice. Your date-only birth date and optional gender selection remain in the app's private storage on your device and are not sent to MORPH's servers or analytics. You may capture or upload only your own face or the face of another adult who is present, has received the applicable notices, and has clearly authorized the specific capture and processing. You may not accept these Terms or any consent for another person unless you have legal authority to do so. ## 3. What Morph is—and is not Morph is a cosmetic, educational, self-care, and entertainment application. It may provide an on-device appearance study, an editorial score or band, visible-surface measurements, evidence labels, general action information, progress tools, a labeled visual simulation, and optional cloud features. Morph does not provide medical, dermatological, dental, orthodontic, psychological, psychiatric, diagnostic, or surgical advice. It is not a medical device, health-care provider, emergency service, or substitute for an appropriately qualified professional. Do not use the Services to diagnose, treat, cure, mitigate, or prevent any condition. Seek professional help for a health concern and emergency services for an emergency. Scores, bands, measurements, reports, recommendations, and generated content may be incomplete, inaccurate, unavailable, or unsuitable for you. They are not statements about your worth, identity, health, protected traits, or eligibility for a product, procedure, benefit, employment, credit, insurance, housing, or other consequential decision. ## 4. Visual simulations, AI, and 3D results A visual simulation applies only disclosed, named surface or grooming directions. It is illustrative—not a forecast, expected result, treatment plan, or evidence that your appearance or score will change. Morph does not sell or display a promised numeric uplift. Studio 3D and Gaussian results are appearance visualizations. They are not internal-anatomy measurements, metrically complete identity models, surgical plans, treatment recommendations, or predicted clinical results. They do not model suitability, bite, osteotomy, healing, complications, or outcomes. Unobserved or generated regions may be missing or inferred and must not be treated as measured subject evidence. The single full-experience agreement authorizes the connected AI purposes and recipients specifically disclosed in Section 5. No request is sent merely because you agree: a connected feature operates only when you deliberately use it, and only when its account, entitlement, provider, safety, licensing, allowance, device, and release gates are satisfied. A model may produce errors or unexpected text or images. Deterministic app rules, not a language or image model, remain the authority for admitted measurements, scores, and selected actions. Do not rely on generated content for a medical or other high-impact decision. ## 5. Face-data notice, permission, and destruction schedule This section is Morph's written notice for face-related processing. We describe the data conservatively as "Face Data" even where a law may not classify a photograph or particular derived value as a biometric identifier or biometric information. Depending on the feature and device, Face Data may include: - face photographs and selected video frames; - TrueDepth or other depth samples used by the released capture method; - face landmarks, camera pose, surface geometry, meshes, and capture-quality evidence; - ratios, angles, distances, symmetry values, scores, evidence labels, and other measurements derived from a capture; and - an optional Gaussian appearance model and its quality and capture receipt. Morph collects face evidence from the camera only after iOS camera permission and your electronic acceptance of these Terms. It processes Face Data only to perform the study or appearance feature you request; display and save your local portrait, measurements, score, report, comparison, or visual scenario; check capture quality and repeatability; create a separately requested visual simulation or Gaussian model; and protect, debug, delete, or audit those exact functions. Morph does not use Face Data for recognition, authentication, surveillance, law enforcement, advertising, or a legal or similarly significant decision, and it does not sell, lease, trade, or otherwise profit from Face Data. Ordinary studies—including portraits, raw measurement records, landmarks, depth evidence, and meshes—stay in app-private storage on your device. MORPH does not receive them for scoring, sign-in, ordinary sync, or analytics. The checked release has no approved external image processor and uses a labeled on-device illustration. Before any future image processor is enabled, Morph must identify it in the agreement and Privacy Policy and present a new Terms version for acceptance before sending a portrait. Cloud Gaussian reconstruction is unavailable in the ordinary release. The single agreement includes explicit permission for that named purpose, but the feature remains blocked unless it is approved for an internal or future release and you use it while signed in. Only selected reconstruction views, their calibration, and the same-session point seed may reach Morph's private GPU worker. A validated clean Gaussian bundle may be promoted to private account storage; it contains the cleaned model, preview, quality report, capture receipt, and manifest—not source photos, raw depth, or working checkpoints. By accepting this version, you specifically authorize these full-experience purposes when you deliberately invoke their corresponding features: - **Morph account services and private storage:** account identifiers, consent receipts, selected portrait-free report backups, deliberately published portrait-free report links, and validated Gaussian bundles may be processed by Morph's authenticated API, Postgres, and private Supabase storage. - **AI explanations:** portrait-free display findings, method and limitation text, approved action IDs, your question, and a bounded conversation may be routed through OpenRouter and an eligible third-party model host under the configured no-data-collection and zero-retention requirements. Portraits, raw landmarks, raw geometry, date of birth, gender, and local profile fields are excluded. - **Visual simulation:** if a reviewed image processor is later named in a new accepted Terms version, one portrait you choose may be sent through Morph's authenticated API only after you request that simulation. - **Gaussian reconstruction:** selected multiview photos and calibration may reach Morph's private GPU worker only after you submit a released job; worker evidence is deleted within the schedule below. - **Product events:** Morph may receive coarse events tied to a random per-launch session. They contain no portrait, score, raw measurement, account ID, transaction ID, or persistent device identifier, and face or depth data is not used for advertising, marketing, or data mining. MORPH applies this retention and permanent-destruction schedule: - **On-device studies:** remain until you delete a study, delete all studies, or remove the app. MORPH cannot remotely retrieve or erase data it never receives. - **Temporary capture files:** are removed after the documented capture and packaging process. An abandoned, unarchived Gaussian working take is removed within 24 hours. A take you deliberately archive in Files remains under your control until you delete it and is never uploaded. - **Cloud visual-simulation copies:** are not retained by the Morph API after the request. A future processor-specific period must be disclosed before that processor is enabled. - **Gaussian worker evidence and working output:** are job-isolated and deleted after verified promotion or deletion, and no later than 24 hours under the worker schedule. - **Private account Gaussian bundle:** remains only while needed to provide the requested cross-device model, until you delete the asset or account, and never longer than three years after your last interaction with MORPH. This feature must remain disabled until that maximum is automatically enforced and verified. - **Acceptance receipt:** the latest account-linked version and decision remain until account deletion. A local version and timestamp remain until you reset Terms and privacy choices or remove the app. MORPH permanently destroys Face Data in its possession when the initial purpose is satisfied or within three years after your last interaction, whichever occurs first, except where a shorter period above applies or law requires preservation. MORPH discloses Face Data only to a processor needed for a feature disclosed in and authorized by this single agreement, a person you deliberately authorize through export or sharing, under valid legal process, or in a legally permitted business transaction with protections at least as restrictive as these Terms. Portrait-free report backup and sharing exclude portraits, frames, raw landmarks, depth, meshes, textures, and Gaussian models. Morph uses app-private storage, iOS data protection, Keychain session storage, HTTPS in production, authenticated account boundaries, private object storage, job isolation, integrity hashes, and deletion controls. No security measure is perfect. By tapping **Agree & enable full experience**, you acknowledge this written notice, authorize the described on-device collection and processing, grant the five named full-experience permissions above, and adopt that action as your electronic signature and written release where applicable. There are no feature-by-feature permission switches. No data leaves merely because you agree; transmission occurs only after you deliberately use the corresponding feature. You may withdraw the entire agreement through Settings, which stops new face processing until you accept the current Terms again, revokes the server receipts, stops new connected requests, and requests deletion of outstanding cloud reconstruction work. Withdrawal does not automatically erase on-device studies; use the study deletion controls for those. Withdrawal does not make earlier authorized processing unlawful and cannot retrieve a copy someone made from a report link while it was active. ## 6. Your content and permission to operate enabled features You retain the rights you have in portraits, captures, questions, preferences, and other material you provide ("Your Content"). You give MORPH and its processors a limited, non-exclusive, worldwide, royalty-free license to host, copy, transmit, transform, and display Your Content only as necessary to: - operate the feature you deliberately request; - protect the Services and enforce these Terms; and - comply with law. This license ends when the relevant content is deleted, except for transient copies being removed through documented retention processes and material we must preserve for legal claims or obligations. We do not acquire ownership of Your Content. You represent that you have the rights and permissions necessary to provide it. ## 7. Accounts and security An account is optional for local studies but required for server-managed features. Keep your Apple or Google account and device secure. Do not share an authenticated session or try to access another person's account, data, report, job, or subscription. Tell us promptly if you believe your account or a shared report link has been compromised. You may delete your account in Settings. Account deletion removes account data handled by MORPH as described in the Privacy Policy. It immediately cancels a website subscription by deleting its Stripe customer, but it does not cancel an App Store subscription or automatically delete separate on-device studies. Cancel an App Store subscription through Apple and use the on-device deletion controls separately. A website subscription can also be managed before account deletion through the Stripe billing portal linked from your website account. ## 8. Morph Pro subscriptions Morph Pro may be offered as the same weekly auto-renewable release access through Apple In-App Purchase or Morph's website, plus optional one-time report packs and a separately disclosed friend code. The applicable purchase screen shows the product, price, currency, billing period, renewal, and included benefits before you confirm. An Apple subscription is confirmed with Apple. A website subscription is confirmed in Stripe Checkout and managed through the Stripe billing portal. Each renews for the selected period until cancelled through the payment channel used to purchase it. The checked release offers no free trial or temporary introductory billing period. A limited-time website signup price may be offered to new customers; the checkout states the exact recurring amount and duration. “Limited-time” describes signup availability, not a hidden later price increase: the selected web price renews unchanged until cancellation unless a future price change is made with required notice or consent. We will not add a trial or genuinely introductory period without displaying its duration, post-offer price, eligibility, and renewal terms in the applicable checkout. Subscription access does not include a physical product and does not promise that a disabled, unapproved, or unavailable cloud feature will be enabled. Material usage limits must be disclosed before purchase or use. The current U.S. website signup prices are **US$29.99 per week** for Morph Weekly (one full scan each week and the rest of Morph), one-time report packs of **US$34.99 / US$59.99 / US$79.99** for 1 / 3 / 10 extra full scans, and the one-time **FRIENDT99** friend code of **US$20** for 90 days with three full scans a week. FRIENDT99 does not renew and can be used once per Morph account. There is no annual website signup price. The current U.S. App Store weekly price matches the website weekly price when that product is offered. The live Apple purchase sheet or Stripe Checkout is authoritative for the exact price, currency, duration, and renewal terms offered to you before purchase. Apple handles payment, tax, renewal, cancellation, and refund requests for App Store purchases. Stripe handles those functions for website purchases as described at checkout and in the billing portal. For an Apple purchase, cancel in iPhone Settings → Apple Account → Subscriptions or through Manage Subscription in Morph. Cancellation normally stops the next renewal and access continues through the paid period. Use Restore Purchases in Morph to refresh eligible Apple-signed access. Apple controls App Store refund requests. For a website purchase, use Manage billing on your signed-in Morph website account. Cancellation normally stops the next renewal and access continues through the paid period. Website billing is linked to the authenticated MORPH account used at checkout. Deleting the app does not cancel website billing; deleting your MORPH account deletes the linked Stripe customer and cancels its website subscription, so access may end immediately. Website refund requests go through MORPH support and any remedy shown in Stripe's billing flow. Deleting the app or your MORPH account does not cancel an Apple subscription. Nothing in this section limits a non-waivable consumer right. We may change included benefits prospectively when reasonably necessary for security, law, licensing, provider availability, quality, or sustainability, but we will not replace an advertised paid benefit with a materially different promise without the notice or consent required by the applicable payment channel or law. Financial support and beta access are independent. A payment does not purchase, guarantee, accelerate, or improve eligibility for a TestFlight invitation or other prerelease access. Beta applications are reviewed separately under MORPH's permission controls. If beta access is granted, it is not a paid subscription benefit and may be changed or withdrawn for testing, capacity, safety, or operational reasons. ## 9. Physical products Digital subscriptions and physical goods are separate. If Morph later offers a physical product, the checkout must display the item, one-time price, taxes, shipping, delivery limitations, return/refund terms, and any recurring purchase before you confirm. The current release does not enroll anyone in physical product auto-ship. A physical purchase, if enabled, is processed through the displayed payment provider and is not an Apple In-App Purchase. ## 10. Acceptable use You may not: - capture, upload, analyze, or share another person's face without their clear permission and all legally required notices or consents; - use Morph to identify, authenticate, surveil, track, harass, shame, demean, discriminate against, or make a consequential decision about another person; - use results to claim a diagnosis, protected trait, ancestry, biological age, mental state, criminality, or guaranteed appearance outcome; - submit unlawful, infringing, deceptive, sexually exploitative, or abusive content, including any sexual content involving a minor; - bypass access, consent, entitlement, allowance, safety, privacy, deletion, or retention controls; - probe, scrape, reverse engineer, disrupt, overload, or introduce malicious code into the Services, except to the extent a restriction is prohibited by law; - resell, sublicense, or commercially exploit the Services or their output without written permission; or - use the Services in violation of applicable law or third-party terms. ## 11. Our content and intellectual property The Services, software, design, trademarks, documentation, scoring methods, curated content, and non-user materials are owned by MORPH or its licensors and are protected by intellectual-property laws. Subject to the Standard EULA and these Terms, we give you a personal, limited, revocable, non-exclusive, non-transferable right to use the Services for their intended consumer purpose. No other right is granted. If you send feedback, you allow us to use it without restriction or payment, provided we do not identify you publicly without permission. ## 12. Third-party services and content The Services may use Apple, Google, Supabase, payment/fulfillment providers, and separately approved AI or GPU processors. Their services may be governed by their own terms. Public educational sources and third-party links are provided for context; a link or citation is not an endorsement. You must comply with applicable third-party terms, including your wireless-data agreement. ## 13. Availability, changes, and termination We may fix, update, limit, suspend, or discontinue a feature for security, legal, provider, licensing, cost, quality, or operational reasons. Local offline features remain subject to device and OS compatibility. We do not promise uninterrupted, error-free, or perpetual availability. We may suspend or terminate access if you materially violate these Terms, create risk or harm, or if required by law. Where reasonable, we will give notice and an opportunity to export or delete eligible data. You may stop using the Services at any time. Sections that by their nature should survive—such as ownership, disclaimers, liability limits, and accrued payment obligations—will survive termination. ## 14. Disclaimers To the maximum extent permitted by law, the Services and all output are provided "as is" and "as available." MORPH disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted availability. We do not warrant any appearance, health, commercial, or personal outcome. Nothing in Morph is medical, dermatological, dental, orthodontic, psychological, psychiatric, nutritional, pharmaceutical, or surgical advice. A score, measurement, image, action, report, source, coach response, or 3D visualization cannot diagnose a condition, determine treatment, or establish that a product or procedure is safe or suitable for you. Contact an appropriately qualified professional about symptoms, distress, allergies, medications, devices, injectables, procedures, or surgery, and local emergency services for an emergency. If appearance-related use causes distress, compulsive checking, or thoughts of self-harm, stop using Morph and seek immediate help from a qualified professional or local crisis service. Results depend on camera, device, lighting, pose, expression, occlusion, capture quality, model version, and available evidence. Visible-surface measurements are not complete anatomy. Unobserved, generated, or generic content is not measured personal evidence. Population context is not a diagnosis, percentile of worth, or universal ideal. Visual simulations are illustrations, not predictions, before-and-after claims, guarantees, or expected outcomes. Patch-test topical products, follow manufacturer instructions, stop after an adverse reaction, avoid known allergens, and consult an appropriate professional. General educational actions cannot account for every condition, medication, pregnancy, allergy, skin type, or contraindication. Morph does not recommend prescription drugs, hormones, anabolic agents, research chemicals, injections, or an individualized medical dose. Some jurisdictions do not allow certain warranty exclusions, so those exclusions may not apply to you. ## 15. Limitation of liability To the maximum extent permitted by law, MORPH and its providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, data, or opportunities, arising from the Services or their output. To the maximum extent permitted by law, MORPH's total liability for all claims arising from or related to the Services will not exceed the greater of (a) the amount you paid for the Services during the 12 months before the event giving rise to the claim or (b) US$100. These limits do not exclude liability that cannot legally be excluded, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where applicable. They do not limit non-waivable consumer rights. ## 16. Claims and applicable rights Before starting a formal claim, you and MORPH agree to try in good faith to resolve it by sending a written description to the contact below and allowing 30 days for a response, unless urgent relief or applicable law makes that unreasonable. These Terms do not require arbitration and do not waive a right to participate in a class or representative action. The law and courts that apply depend on the App Provider identified on the App Store product page and mandatory rules in your place of residence. Nothing in these Terms deprives you of non-waivable consumer protections or your right to contact a regulator. ## 17. Export and sanctions compliance You represent that you are not located in a country or region subject to a U.S. Government embargo or designated as supporting terrorism and are not on a U.S. Government prohibited or restricted-party list. You must comply with applicable export-control and sanctions laws. ## 18. Changes to these Terms We may update these Terms to reflect a material product, legal, or operational change. We will revise the effective date and, when required, present the new version for affirmative acceptance before further use. Changes do not apply retroactively where prohibited by law. ## 19. Contact Questions, complaints, or claims: **support@morph.app** The App Store seller information or another legally sufficient disclosure must also provide any required mailing address and telephone number. Do not rely on this email until the domain has a working mail service.
